I. Definitions
1."We" in these Guidelines refers to the ToMoviee AI operated by Wondershare, including services provided via web pages, PC clients, mobile apps, and other forms, hereinafter referred to as "We".
2.These Guidelines aim to introduce common types of infringements, the complaint and appeal processes, etc., on "We", including but not limited to:
(1) Infringements of intellectual property rights such as copyright, trademark, patent rights, and other intellectual property rights.
(2) Infringements of personal rights and interests such as the right to one's name, the right to an entity's name, reputation rights, honor rights, portrait rights, and privacy rights.
3.Upon receiving compliant complaint materials, We will handle them in accordance with relevant laws and regulations. Please ensure you submit complaint materials that are authentic, complete, accurate, and lawful (including, but not limited to, primal facia evidence of infringement, the genuine identity information of the rights holder, links to the allegedly infringing content, etc.).
4.Complainants shall adhere to the principle of good faith, take responsibility for the authenticity, legality, and validity of the complaint materials, and shall not lodge complaints maliciously. Otherwise, they shall bear all legal liabilities arising therefrom, including but not limited to economic losses caused to We and the respondent.
II. Infringement Complaint Process
(A) Submitting a Complaint
If you discover that others have infringed upon your lawful rights and interests, you may file a complaint with We via the complaint email address [ ] or the in-product feedback channel [Specific Path:]. To ensure more accurate and efficient handling of complaints, users are advised to directly download the "Notice of Infringement Complaint", fill in the information completely and accurately according to the document's requirements, provide the necessary materials, sign the notice (or affix the organization's seal), and submit the scanned electronic copy to the complaint email address.
Complaint materials should include the following:
1.Proof of the Rights Holder's Genuine Identity and Contact Information.
1.1 Individual users must submit scanned copies of valid identification documents (including the photo page) and valid contact information.
1.2 Enterprise users (legal persons or other organizations) must submit scanned copies of entity qualification documents (e.g., business license, stamped), a power of attorney for the designated contact person, valid contact information, and address.
2.Primal Facia Evidence Constituting Infringement
The required materials may vary depending on the type of infringement. Beyond screenshots of the infringing content, rights holders must provide proof of ownership documents. Common infringement types include intellectual property rights and personal rights infringement.
2.1 Intellectual Property Rights
(1) Copyright: Copyright registration certificate; Proof of first publication of the work (including date); Manuscripts; Proof of work creation timestamp; or other proof of ownership materials.
(2) Trademark Rights: Trademark registration certificate.
(3) Patent Rights: Patent certificate; Patent infringement comparison statement.
2.2 Personal Rights
(1) Portrait Rights: Materials proving the rights holder possesses the relevant portrait right, such as clear personal photos.
(2) Privacy Rights: Materials proving the rights holder possesses the relevant personal privacy information, such as a statement of circumstances.
(3) Name Right / Entity Name Right: Evidence proving the unauthorized use of the rights holder's name or entity name.
(4) Reputation Rights / Honor Rights / Business Reputation Rights: Evidence proving the infringing content fabricates false information, allegedly infringing upon individual reputation rights or honor rights, along with materials proving the contrary facts.
3.Specific Allegedly Infringing Content and Demands
The rights holder should clearly identify the specific content constituting infringement and specify the type of action they request the platform to take (e.g., removal, blocking). Provide the URL/link address of the infringing content to enable We to accurately locate it and contact the respondent.
4.Rights Holder's Promise
The rights holder must guarantee the truthfulness, legality, and accuracy of the statements and information provided in the complaint materials. The following statement must be included in the complaint materials:
"I warrant that the information stated in this notice is true and accurate, and the ownership proof materials provided are lawful and valid. I voluntarily bear all legal liabilities arising from this notice of complaint and the related materials."
(B) Handling Infringing Content
1.Reviewing Materials
Upon receiving complaint materials, We will conduct a formal review. For compliant materials, We will process them in accordance with relevant legal requirements as promptly as possible. Based on the primal facia evidence of infringement and the notice of complaint, We will take necessary measures such as deletion, blocking, or disconnection of links.
2.Forwarding the Complaint Notice to the Respondent
We will promptly forward compliant complaint notices to the respondent. If the respondent disagrees with the complaint or believes no infringement exists, they may, upon receiving the complaint notice forwarded by We, submit a declaration stating the absence of infringement. They may refer to the "Declaration of Non-Infringement"[Specific requirements align with the materials required for complainants submitting infringement complaints].
3.Upon receiving the "Declaration of Non-Infringement" submitted by the respondent, We will forward this declaration and related materials to the rights holder. We will inform the rights holder that they may accordingly file a complaint with the relevant competent authority or initiate a lawsuit in a People's Court. The rights holder must promptly send notification of such complaint or lawsuit initiation, along with supporting evidence, to the complaint email address support@wondershare.com. Within 15 days from the date the "Declaration of Non-Infringement" is served on the rights holder, if We does not receive notification from the rights holder that they have filed a complaint or lawsuit, We will promptly terminate the measures taken against the respondent.
III. Important Notes
1.Non-infringement complaints are not covered by these Guidelines.
If users discover that information uploaded by others contains illegal or harmful content, they may report it via the "Report" function [Specific Path].
2.As a network service provider, We will conduct only a preliminary review of the complaint content and supporting materials in accordance with legal requirements.
We cannot judge or guarantee the authenticity, legality, or validity of the materials, nor can it substitute for a professional legal adjudication body. We makes no promises or guarantees of any kind regarding the outcome of a complainant's complaint. Except where expressly stipulated by law, We assumes no liability for the results of complaint handling.
